Most cases of defamation occur in two different ways. The first is where an employee is terminated for a false reason. This can overlap with an act of wrongful termination. For instance, if a person is fired due to a false statement of fact, such as a false claim of misconduct, this can be deemed defamation.
The second most common situation involves references and background checks.
